GENERAL TERMS AND CONDITIONS

The general terms and conditions for the operation of the online store Euromidi are drafted in accordance with the Consumer Protection Act (Zakonom o varstvu potrošnikov (ZVPot)), the Consumer Protection Actagainst unfair commercial practices (Zakonom o varstvu potrošnikov pred nepoštenimi poslovnimi praksami (ZVPNPP)), the Electronic Commerce Market Act (Zakonom o elektronskem poslovanju na trgu (ZEPT)), and international codes for e-commerce. The general terms and conditions define the terms of making a purchase on the website Euromidi, available at www.euromidi.eu (hereinafter referred to as "the website"), which is intended for presentation and selling of products to its users. It is run by the independent company Euromidi Uroš Zagožen s.p., Gorica pri Šmartnem 50, 3000 Celje (hereinafter referred to as "the provider").

At registration, the visitor receives a username, which is the same as the e-mail address of the user, and a password. The username and password will identify the user and connect the user with the information of the website. After confirming the registration via e-mail, the visitor becomes a user and obtains the right to make purchases. To change the current e-mail address for another one, the user needs to send a request to [email protected] The change will come into effect the same day or the next working day at the latest, and the user will be notified about the change via e-mail. By using the online store the user accepts and agrees with the terms and conditions, and confirms being informed about the privacy policy.

The general terms and conditions deal with the way the online store operates, the user's rights, and the business relationship between the provider and customer.


1. ACCESSIBILITY OF INFORMATION

The provider binds himself to ensure that the customer always has access to the following information: company identity (name and seat of the company, registration number), contact information, which offers the customer quick and efficient communication (e-mail, phone), adequate qualities of the merchandise or services, availability of products, a timeline for offers, a deadline before which it is possible to withdraw from the contract and conditions on withdrawing, as well as the possible costs incurred during withdrawal, and explanation of the process for filing a complaint, including all relevant information about the contact person or service for contact with customers. All prices must be clearly and unambiguously displayed, and contain information on whether delivery costs are included besides payment and shipping methods.


2. PRICES

The prices are in euros and do not contain VAT (the provider is not subject to VAT). The prices are valid at the time of placing the order. Descriptions of products and prices may contain errors. We reserve the right to change product prices without prior notice. All prices and special offers are subject to the deadline referred to at the beginning of the promotion. The prices listed on the website do not include the costs of packaging and postage.


3. PURCHASE PROCESS

On the website www.euromidi.eu the user selects a product and clicks on the link "Add to cart". The product is then automatically transferred to the cart and the user can continue with the order. With the click on the cart icon the user can view what products are added and is able to delete them from the cart.

To complete an order, the user must click on the "Checkout" icon and then on the "Continue with order" icon. Users must register and enter personal data when first logging in, registered users must log in with their username and password. The user selects the payment method. The delivery is made by the national postal service Pošta Slovenije d.d.

After submitting the order, the customer receives an automatically generated e-mail containing the details of the order. The user will also be notified by e-mail when the product is sent or when the download of the product is enabled on the website (depending on the payment method).

The user is able to make changes to an order or cancel it by sending a message to [email protected] before the product is made ready for shipping or the download is made available. If the product is already sent or downloading enabled, the customer may refuse the shipment, but is obligated to cover the costs of shipping.


4. PAYMENT METHOD

4. 1 Cash on delivery

Delivery of products by mail is not possible. Delivery is carried out exclusively via a website with download links, which you receive via email. 

4. 2 Advance payment (deposit to the bank account of the provider)
After an order is placed, the customer receives information for making a deposit to the account of the provider using the Universal payment order (UPN). The customer receives the invoice via e-mail after completing the payment. The customer will be notified via e-mail that downloading has been enabled within 24 hours (usually in a few hours).

4. 3 Credit card/PayPal payment (Eurocard/Mastercard, Visa, Visa Electron, American Express)
The customer is redirected to a website where it is possible to make a secure payment with a credit card or PayPal account. After the payment is completed, an e-mail is sent automatically to the customer that downloading has been enabled. A credit card fee of 3,4% plus EUR 0,36 will be added. The invoice for the completed payment will be sent to the customer via e-mail.


5. DELIVERY TIME

The products in the offer are always in stock and can be deliver immediately after receiving  payment. 

5. 1 Cash on delivery
Delivery of products by mail is not possible. Delivery is carried out exclusively via a webshop with download links, which you receive via email.

The delivery times are valid from the date of the order confirmation or after receiving the payment. The customer will be notified via e-mail that downloading has been enabled within 24 hours (usually in a few hours).

5. 3 Credit card/PayPal payment
After making the payment, the buyer immediately automatically receives e-mail with download links and another e-mail with invoice.


6. DELIVERY COSTS

Delivery of products by mail is not possible. Delivery is carried out exclusively via a webshop with download links, which you receive via email. Downloading products via links is free.


7. RIGHT TO WITHDRAW THE PURCHASE, RETURN OF GOODS 

The buyer has the right to withdraw from the contract/purchase precisely by notifying the provider in writing of the withdrawal from the contract/purchase within fourteen (14) days of receiving the shipment to the email address [email protected], and returning the goods to the provider within thirty (30) days of sending written message, by covering the direct costs of the return. The goods must be returned unused and undamaged, and a copy of the invoice must be attached. After the expiration of at least one of the stated deadlines, withdrawal from the contract/purchase is not possible. Returning the goods to the provider within fourteen (14) days of receipt is considered a notice of withdrawal from the contract. The provider does not accept shipments against a ransom. The purchase price will be returned to the buyer as soon as possible, but no later than thirty (30) days after receiving the returned goods. The purchase price will be returned to the buyer exclusively to his transaction account. For all music files (midi, mp3 karaoke, video karaoke), a preview in the form of listening to the audio file is possible before purchase, so the return or exchange of music files or withdrawal from the contract after purchase is not possible if the song has already been downloaded from the link. If the song has not yet been downloaded from the link, it is possible to cancel the order or replace it with another product. Possibility of return or the withdrawal from the contract does not apply to music compact discs (CDs) and DVD films in the event that the original packaging, including cellophane or protective shrink film, has been removed.

8. EXCHANGE OF GOODS 

The user has the right to exchange the ordered goods precisely by notifying the company in writing of the exchange of goods to the e-mail address [email protected] within fourteen (14) days after receiving the shipment, and returning the goods to the provider within thirty (30) days of the sent written message, with by covering the direct costs of the return himself. The goods must be returned unused and undamaged, a copy of the invoice must be attached, otherwise we cannot exchange the goods. Exchange is not possible after at least one of the mentioned deadlines has passed. The cost of resending the goods is covered by the provider. If the provider is unable to deliver replacement goods within thirty (30) days of receiving the inadequate goods, he undertakes to refund the purchase price. For all music files (midi, mp3 karaoke, video karaoke), a preview in the form of listening to the audio file is possible before purchase, so the return or exchange of music files or withdrawal from the contract after purchase is not possible if the song has already been downloaded from the link. If the song has not yet been downloaded from the link, it is possible to cancel the order or replace it with another product. Possibility of return or the withdrawal from the contract does not apply to music compact discs (CDs) and DVD films in the event that the original packaging, especially cellophane or protective shrink film, has been removed.


9. SAFETY

The provider uses appropriate technological and organizational means to ensure secure downloading and storing of personal information, orders, and payments. However, even with regular control the user information can never be fully protected. The provider assumes no responsibility and cannot be liable for any computer damage and/or damage to physical components or other property, as well as potential virus infections, that could impair the user's equipment by visiting the website and/or downloading texts, images, information, and video and audio recordings. The user is also responsible for protecting his account information and password. The user is responsible for the accuracy and truthfulness of the submitted information and is liable to the provider for any damage incurred due to inaccurate and false information.


10. PRIVACY POLICY

The provider binds himself to protect personal information in accordance with the Personal Data Protection Act (Zakonom o varstvu osebnih podatkov (Ur. l. RS št. 86/2004)) and the Electronic Communications Act (Zakonom o elektronskih komunikacijah (ZEK-om, Ur. l. RS, št. 43/2004)). All of the information gained from the website www.euromidi.eu will be used solely for the purposes of filling out order/return/replacement forms, sending of newsletters and promotional material, invoices, and other necessary communication. Promotional e-mails and text messages (sms) must be clearly and unequivocally labeled as promotional messages, and the sender properly identified. If the user requests not to receive promotional material, the provider must respect the request unconditionally. 11. ABSOLUTION OF RESPONSIBILITY

The provider will do his best to ensure promptness as well as validity of information contained on the website. However, characteristics of products, delivery times, or prices may change so rapidly as not to permit the provider to correct the information on the website in due time. In such cases, the provider will inform customers about the changes and allow them to withdraw from the order or choose a replacement of a product. All featured images are symbolic and are not the property of this website, neither do they claim to depict the correct characteristics of the product. The provider is not responsible for any typing errors. 12. COMPLAINTS AND DISPUTES

The provider respects the current consumer protection legislation. Complaints or requests for refunds may be sent by e-mail to [email protected] or by traditional post to the following address: Euromidi Uroš Zagožen s.p., Gorica pri Šmartnem 50, 3000 Celje. 
The provider must confirm he received the complaint within five (5) days and notify the user of how long it will take to treat the complaint, as well as keep the user informed of the proceedings. The provider will make every effort to resolve any dispute amicably. If this is not possible, the jurisdiction for resolving disputes lies with the District Court in Celje.
